Henny's approach to litigation matters for clients is guided by a sensible attitude to find solutions in a cost-effective manner advising clients through the complexities of high stakes litigation. Henny’s experience includes representation in litigation matters for individuals and businesses, including contract disputes, shareholder disputes, business dissolution cases, fiduciary issues, real estate litigation, trade secrets, and other general business matters. Henny also provides guidance and representation on business disputes involving valuation and forensic matters, including forensic litigation and valuation of business interests in corporations, partnerships, limited liability companies and joint ventures. Representing individuals and businesses ranging from startup/small businesses to multi-national corporate organizations, Henny helps clients navigate through general corporate issues and litigation mitigation strategies.
Henny also provides representation in dissolution of marriages and other family law related matters, including business/corporate dissolution and valuation, prenuptial and postnuptial negotiations and agreements, post-judgment modification and enforcement proceedings, paternity cases, domestic violence matters, adoptions, mediations, and other general family law representation. Henny represents individuals in these actions as well as businesses that become involved, as a party or non-party, in navigating through the complexities of litigation with an eye to seek solutions.
In probate and trust litigation, Henny has represented individuals, as beneficiaries, creditors, personal representatives, trustee/co-trustee, as well as businesses in probate, guardianship, and trust related matters. He has also handled over five-hundred non-jury trials on behalf of commercial and consumer lenders across the State of Florida in the field of creditor’s rights, and represents creditors enforcing their rights in collection matters, including garnishment proceedings, bankruptcy, and post-judgment enforcement/collection, including successful enforcement of foreign judgments for clients from other states here in Florida.
Henny advises clients on a broad range of issues and utilizes his litigation experience to advise clients on their general corporate issues and needs taking the same approach to efficiently and effectively solving problems in combination with Tripp Scott's group of skilled lawyers teaming up to find solutions for clients.
Henny's notable representations include:
An international businesswoman in a complex long-term divorce action involving businesses and international transactions in which the opposing party fought disclosure of documentation resulting in substantial litigation in several jurisdictions with multiple evidentiary hearings which resulted in obtaining monetary and injunctive relief in favor of the client. Subsequently, the monetary judgment was domesticated in Germany and was opposed, ultimately being upheld by the Federal Court of Justice (Supreme Court of Germany). In the United States, the matter went to trial which resulted in a judgment in favor of the client, which was ultimately upheld on appeal.
A purchaser of a multi-million dollar aircraft against a manufacturer that fought in both Florida and Texas state court proceedings regarding breach of warranties and dangerous design flaws in the aircraft's hull. Through the court process, Henny was successful in obtaining a dismissal of the action in Texas both on jurisdictional and lack of merit and the Florida matter resulted in a favorable outcome for the client.
A distinguished professor in an action against an academic institution for breach of an endowment in state court. The matter, which was litigated over four years, included substantial briefing on issues relating to the issue of interpretation of intent on the thirty plus year old endowment letter, purpose for use of funds, and handling of the funds by the institution. After extensive court hearings, substantive depositions of key players, and extensive discovery, the matter was favorably resolved on behalf of the client.
A physician in a complex litigation matter stemming from a disagreement in the partnership over a medical practice and ownership in their building resulting in a business valuation dispute. Ultimately after examination of the information and proving the methodologies used by the client were correct, a favorable result was obtained in the purchase of his interests in the business.
A veterinarian animal hospital in federal court litigation after being sued by its former partner based on breach of contract and specific performance to buy his interests out of their practice. The case involved substantial legal and factual issues ranging from jurisdictional issues as well as incorrect business valuation methods in substantiating the alleged claims owed. After numerous court hearings and a forensic analysis and valuation of their assets, a favorable result was obtained for the client.
A property owner with an estranged significant other for several years which resulted in a complex partition action and forensic analysis as to the contribution into the property resulting in a favorable outcome for the client.
An out-of-state plaintiff by successfully domesticating a New York judgment against a defendant who hid assets, including subsequent attempts to move assets abroad, that resulted in the collection of all monies including attorney's fees for the client.
A condominium owner who suffered substantial damages to his multi-million dollar condo that was the result of a flooding incident from an adjacent property owner’s water leak stemming from an ongoing renovation and the building management/association’s failure to address the damages. The water leak was exacerbated by a common element defect with the building plumbing created a mold situation in the unit. After filing an action against the property owner, association, and insurance carriers, which included extensive motion practice and depositions, the case ultimately resulted in a favorable outcome for the client.
A property owner in a delicate dispute with his co-owner/brother involving the value of a commercial property in a partition action navigating the dispute on differences in valuation of the asset resulting ultimately in a favorable settlement for the client.
An Florida attorney who faced a significant claim for damages due to an international cybersecurity breach involving one of his clients that resulted in a complex litigation matter with numerous financial institutions in both state and federal court which ultimately was resolved.
An accomplished doctor and businessman seeking to dissolve a moderate term marriage with children with delicate personal issues leveraging experts in valuing multiple business interests and accomplishing a resolution creating value for the client, the family, and a plan that was in the best interests of their children.
A New York resident sued in a dissolution of marriage action by his spouse in Florida navigating the jurisdictional issues and different laws applicable to the case and the relationship in Florida state court.
A law firm defending a lawsuit claiming breach of contract by a client, which involved novel issues of law, demonstrating that the client had no basis for liability, and the case settled favorably for the client.
