Tripp Scott Attorneys Named Legal Elite by Florida Trend Magazine

Tripp Scott today announced that Matthew Zifrony and Jeffrey Fauer, both directors with the firm, were selected by their peers as Florida Trend Magazine’s 2020 Florida Legal Elite.

The Florida Legal Elite are the top lawyers practicing in Florida, according to the results of the magazine's statewide attorney surveys. The special issue, which goes on stands in July, provides Florida Trend readers with an extensive list of the state’s most prominent attorneys.

Zifrony serves as general counsel for several large companies and provides strategic counsel for corporate contractual and transactional issues.  He also provides property financing and transaction counsel to buyers, sellers, lenders and developers of residential and commercial real estate.  Zifrony is also the president of one of the largest homeowners associations in Broward County and represents numerous condominium and homeowners associations in the tri-county area, providing counsel on such issues as collections, rules enforcement, contractual review and association documents.

Fauer focuses his practice in the areas of probate litigation and complex business litigation. An AV® Preeminent™ Peer Rated attorney by Martindale Hubbell®, he has represented clients at all stages of litigation, from inception through trial and appeal.  He has litigated a variety of cases including will contests, personal representative removal proceedings, trust disputes, shareholder and partnership disputes, and general contract matters.  Fauer has been recognized by Super Lawyers®, part of Thomson Reuters, as a “Rising Star” naming him as one of the top 2.5% of lawyers, and by South Florida Legal Guide as a “Top Up and Comer”. Fauer is also the Chair Elect for Leadership Broward Foundation.

Florida Legislature Enacts Recent Changes to Statute of Limitations and Statute of Repose Affecting Construction Litigation

On April 13, 2023, Florida’s Governor Ron DeSantis signed into law Florida SB 360, which, among, other things, shortens the statute-of-repose period for commencing an action based on the design, planning, or construction of improvements to real property.  See ch. 2023-22, Laws of Fla. (2023).  The new law went into effect immediately upon signing; however, the amendments to the statute of limitations and statute of repose set forth in section 95.11(3)(c), Florida Statutes (2023), apply only to actions commenced on or after the act’s effective date, regardless of when the cause of action accrued. See ch. 2023-22, § 3, Laws of Fla. (2023).  An exception is that any action that would not have been barred under section 95.11(3)(c) before the act was amended “must be commenced on or before July 1, 2024.” Id.
